Paid Sick Leave

Healthy Workplace Healthy Family Act


California's Healthy Workplace Healthy Family Act ("HWHFA") requires employers to provide accrued paid sick leave to an employee for health-related issues or if an employee is a victim of certain crimes. 


An employee earns one hour of sick leave for every 30 hours worked with accrual occurring after 30 days of employment and available for use after 90 days of employment. As of January 1, 2024, the minimum paid sick leave entitlement for California employees increased to five days or 40 hours. 


An employee who uses their accrued paid sick leave can't be retaliated against by their employer for using their leave.  with presumed retaliation if adverse actions occur within 30 days after the employee exercises their rights.


Kin Care Act


California's Kin Care Law allows an employee to use up to half of their accrued sick leave for the care of a family member or a "designated person," with the latter defined as someone with a blood relationship or an equivalent familial bond to the employee, as chosen by the employee at the time leave is requested.
